Car Rental Agreement

3. CONDITION OF VEHICLE:

3.1 The Owner states that to the best of his knowledge and belief that the above-

described vehicle is in sound and safe condition and free of any known defects or

faults which would affect its safe operation under normal use. The vehicle has

been serviced and any notable scratches, dents, and any other problems will be

noted on the vehicle check sheet attached to this agreement.

4. QUALIFICATIONS:

4.1 The Renter states that he / she is physically and legally qualified to operate the

above-described vehicle and will not allow any operation or use of the said

vehicle by any other persons without necessary driving license and experience

without express consent of the owner. Any such event, even if no accidents occur

will cause the renter to be legally dealt with at the renter’s expense deducted from

the deposit and any such shortfalls will be due to be paid by the renter in addition

to a US$200.00 penalty.

7. RENTAL RATE:

7.1 The Renter hereby agrees to pay the owner at the rate of ____________ per day.

7.2 All fuel used shall be paid for by the Renter, and the vehicle should be washed

and fueled on pick-up and drop off, on a full-tank policy.

8. EXCLUSIONS:

8.1 The rented vehicle shall not be used to carry passengers or property for hire or

hiking.

8.2 The rented vehicle shall not be used to carry passengers other than in the interior

or cab of the vehicle.

8.3 The rented vehicle shall not be used to push, propel or tow another vehicle, trailer

or any other thing without the written permission of the Owner.

8.4 The rented vehicle shall not be used for any race or in any competition.

8.5 The rented vehicle shall not be used for any illegal purpose.

8.6 The Renter shall not operate the vehicle in a negligent manner.

8.7 The rented vehicle shall not be operated by any other person other than the Renter

stipulated in 1.2 above without the written permission of the Owner. If Renter

allows any other driver under the age of 25 years old to drive the rented vehicle,

the Renter will be fully responsible for all expenses relating to the rental car and

any other Vehicle involved in any type of accident.

8.8 The Renter shall not drive above the General Speed Limit 120km/h, and in case of

such need to adjust the Renter can only limit excess speed to within 130km/h.

8.9 The Renter shall not make sudden braking or take-off during the tenure of the

hire.

8.10 The Renter shall not drive the vehicle at high speed on bad roads.

Any events violating the exclusions above trigger a US$100 penalty for 7.1 to 7.7

exclusions and US$40 for exclusions 7.8 to 7.10. Speeding above 150km/h will result in

a US$150 penalty and legal action at the Renter’s cost.

9. INSURANCE, LICENSING:

9.1 The Owner will always provide comprehensive insurance, valid license and ZBC

disks on each vehicle to the duration of the hire. It is the Renter’s responsibility to

check and make sure disks are still valid, and request for new valid disks if they

are not before operating the vehicle. The Renter hereby agrees that he / she shall

be held fully responsible for the shortfalls, if any deductible in case of accident.

The Renter also agrees that only the vehicle is covered under insurance and the

driver or passengers may not be covered. The Renter also agrees that personal

belongings and other items left in the vehicle at any time may not be covered.

10. DEPOSIT:

10.1 The Renter further agrees to make a deposit of $..................... with the Owner,

said deposit to be used, in the event of loss of or damage to the vehicle or

equipment during the term of this Car Rental Agreement, to defray fully or

partially the cost of necessary repairs or replacement.

10.2 In the absence of damage or loss, said deposit shall be credited toward payment of

the Rental Rate and any excess shall be returned to the Renter.

accrue against the deposit US$......./km done. Should excess mileage accrue above

US$100.00 the Renter should plan to pay the amount due within 24 hours. If not

paid, the Owner may immobilize the vehicle and initiate the recovery process at

the Renter’s cost against the deposit.

11. RETURN OF VEHICLE:

11.1 The Renter hereby agrees to return the above-described vehicle to the pick-up

12. JURISDICTION:

12.1 The parties consent that this is a legal binding document Under the Laws

Governing the Republic of Zimbabwe.
